What Clients Say

TC

Tan Chee Keong

Fleet Manager, Penang

"We brought a cargo damage claim to Duskfield after our insurer was being slow to engage. Within weeks the team had reviewed the bill of lading, identified the applicable convention, and put forward a considered position to the counterparty. The final settlement was considerably better than what we had been offered initially."

AS

Ahmad Shahril

Ship Owner, Kuala Lumpur

"The vessel registration work was thorough and well organised. Kelvin walked me through what was needed at each stage, the documentation was prepared without errors, and the Marine Department process was completed within the expected timeframe. I appreciated not being left to figure things out on my own."

February 2026 · Vessel Registration

LM

Lim Mei Shan

Legal Manager, Johor Bahru

"We needed an urgent ship arrest application filed at the High Court over a weekend. Razif was reachable, the paperwork was prepared correctly, and the arrest was executed without procedural issues. The only friction was coordinating the security negotiations afterward — but that was a function of the counterparty, not the firm."

JR

James Rajan

Freight Forwarder, Port Klang

"What stood out was the willingness to explain things clearly without making me feel I should already know the answers. Suraya gave a very even-handed assessment of our freight dispute and recommended we negotiate rather than litigate. That turned out to be the right call."

March 2026 · Shipping & Cargo Claims

NK

Naoko Kimura

Operations Director, Japan (Malaysia Office)

"As a foreign operator dealing with Malaysian port matters for the first time, we were uncertain about who to approach. Duskfield was recommended through our P&I club and the experience justified that recommendation. The cross-border dimension was handled without difficulty, and written updates were clear and timely."

January 2026 · Vessel Registration & Flagging

MH

Mohammad Hanif

Shipping Executive, Klang Valley

"Duskfield handled a complicated collision claim that involved multiple parties across two jurisdictions. The legal issues were explained to our management in plain terms, which helped us make informed decisions. The matter settled after several months of negotiation — not the fastest process, but the outcome was fair."

Case Studies

Matters in Practice

Three representative situations illustrating how Duskfield approaches maritime legal matters from start to resolution.

Case Study 01

Container Cargo Damage at Port Klang

Challenge

An importer discovered significant water damage to a consignment of electronics on arrival at Port Klang. The carrier disputed liability, the surveyor's findings were contested, and the insurer was non-committal. A limitation period was approaching.

Our Approach

We reviewed the bill of lading, survey reports, and the carrier's exception clauses. We identified inconsistencies in the carrier's documentary records, which significantly affected their liability position, then engaged the P&I correspondent and cargo insurer with a detailed legal position paper.

Outcome

The carrier agreed to a negotiated settlement representing approximately 78% of the claimed amount, avoiding litigation. The matter resolved within 14 weeks of instruction.

Timeline: ~14 weeks

Case Study 02

Vessel Re-Flagging from Foreign Registry

Challenge

A ship owner wished to transfer a 4,200 DWT coastal vessel from a foreign open registry to the Malaysian flag for domestic trade route access. The documentation chain was incomplete and two statutory surveys had lapsed.

Our Approach

We worked with the client to reconstruct ownership documentation, liaised with the prior flag state's maritime administration for confirmation letters, identified a Marine Department-approved surveyor, then prepared and submitted the full registration package.

Outcome

The vessel was successfully registered under the Malaysian flag approximately 11 weeks after initial instruction. The client subsequently obtained the necessary coastal trading permits.

Timeline: ~11 weeks

Case Study 03

Ship Arrest Application for Unpaid Freight

Challenge

A shipowner was owed a substantial sum in unpaid freight. The debtor vessel had returned to Malaysian waters and was expected at Port Klang within days — a narrow window existed to arrest it before departure.

Our Approach

We filed the admiralty action and arrest application in the High Court within 36 hours of instruction after verifying the grounds for arrest and preparing the requisite affidavits. The warrant was issued and executed at Port Klang on arrival.

Outcome

The charterer provided a bank guarantee as security within 5 days, allowing vessel release. The freight dispute was subsequently resolved through negotiation, resulting in full recovery plus a contribution to legal costs.

Arrest to release: 5 days
