Case Study 01
Container Cargo Damage at Port Klang
Challenge
An importer discovered significant water damage to a consignment of electronics on arrival at Port Klang. The carrier disputed liability, the surveyor's findings were contested, and the insurer was non-committal. A limitation period was approaching.
Our Approach
We reviewed the bill of lading, survey reports, and the carrier's exception clauses. We identified inconsistencies in the carrier's documentary records, which significantly affected their liability position, then engaged the P&I correspondent and cargo insurer with a detailed legal position paper.
Outcome
The carrier agreed to a negotiated settlement representing approximately 78% of the claimed amount, avoiding litigation. The matter resolved within 14 weeks of instruction.

Vessel Re-Flagging from Foreign Registry
Challenge

Our Approach
We worked with the client to reconstruct ownership documentation, liaised with the prior flag state's maritime administration for confirmation letters, identified a Marine Department-approved surveyor, then prepared and submitted the full registration package.

The vessel was successfully registered under the Malaysian flag approximately 11 weeks after initial instruction. The client subsequently obtained the necessary coastal trading permits.

Case Study 03
Ship Arrest Application for Unpaid Freight
Challenge
A shipowner was owed a substantial sum in unpaid freight. The debtor vessel had returned to Malaysian waters and was expected at Port Klang within days — a narrow window existed to arrest it before departure.
Our Approach
We filed the admiralty action and arrest application in the High Court within 36 hours of instruction after verifying the grounds for arrest and preparing the requisite affidavits. The warrant was issued and executed at Port Klang on arrival.
Outcome
The charterer provided a bank guarantee as security within 5 days, allowing vessel release. The freight dispute was subsequently resolved through negotiation, resulting in full recovery plus a contribution to legal costs.
