We assist with a wide range of cargo claims including damage during transit, shortage claims, misdelivery, and disputes over freight charges. Our work covers both domestic Malaysian carriage and international shipments where conventions such as the Hague-Visby Rules or the Hamburg Rules may apply. We advise carriers, shippers, freight forwarders, and cargo insurers.
How does vessel registration under the Malaysian flag work?
Registration is administered through the Marine Department of Malaysia. The process involves submission of ownership documents, survey certificates, and compliance with the Merchant Shipping Ordinance. We assist ship owners from initial eligibility assessment through to completed registration, and we also advise on ongoing flag state obligations that accompany a Malaysian registry.
Can you help with an urgent ship arrest application?
Yes. Ship arrest in Malaysia is handled through the High Court under its admiralty jurisdiction. Applications can be made at short notice when circumstances require. We handle the drafting of affidavits, coordinate with the court and the arresting officer, and advise on security arrangements to resolve or maintain the arrest as appropriate to your position.
How long does a typical maritime dispute take to resolve?
This varies considerably depending on whether the matter settles through negotiation or proceeds to trial. Many cargo claims are resolved through negotiation within weeks to a few months. Court proceedings in the Admiralty Division typically take longer. We discuss realistic timelines openly at the start of each matter so clients can plan accordingly.
Do you advise international clients with Malaysian maritime matters?
We do. A number of our clients are based outside Malaysia — foreign ship owners, charterers, and cargo interests who have matters arising out of calls at Malaysian ports or vessels registered in Malaysia. We are accustomed to working across time zones and coordinating with overseas counsel when cross-border matters require it.
